Terms of Service

1. Acceptance of Terms

By accessing or using Jonga OCR (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Jonga OCR is a hosted API that extracts structured data from photographs of South African identity documents (Smart ID, Green Book, Driver’s Licence) and international passports.

Access is provided via a REST API at https://jongaocr.co.za/api/v1/*.

Self-serve tiers (Free, Popular, Ultimate) and Enterprise (custom) are available. Current pricing and feature details are published at /pricing.

3. Account Registration and Security

  • You must provide accurate information when creating an account.
  • You are responsible for all activity that occurs under your account.
  • Keep your API tokens secret. Rotate them immediately if you suspect they have been compromised.
  • Jonga will never ask for your API token via email or chat.

4. Acceptable Use

You will not:

  • Use the Service to process documents without a lawful basis to do so under POPIA, GDPR, or other applicable data protection law.
  • Submit documents you do not have permission to process.
  • Scrape, reverse-engineer, or attempt to bypass rate limits or authentication.
  • Redistribute extracted personal information in ways that violate the subject’s privacy rights.
  • Use the Service for fraudulent KYC verification, including money laundering or synthetic identity fraud.
  • Share API tokens across organisations or expose them in public repositories, client-side code, or any other public surface.
  • Use the Service to build a competing OCR product.

You will comply with all applicable laws including POPIA (Republic of South Africa), GDPR where relevant, and any other data protection regimes that apply to your end users.

5. Service Availability and SLAs

  • Free tier: best-effort. No uptime commitment.
  • Popular tier: best-effort with priority support (24 hour response target).
  • Ultimate tier: 99.9% monthly uptime SLA. Service credits are available for sustained breaches — see your tier description at /pricing.
  • Enterprise: custom SLA per contract.
  • Scheduled maintenance will be communicated at least 48 hours in advance where possible.

6. Payment Terms

  • The Free tier incurs no charges.
  • Paid tiers are billed monthly in advance in South African Rand (ZAR).
  • Paystack processes all payments as our payment sub-processor.
  • Failed payments result in tier downgrade to Free after a 7-day grace period.
  • Refunds are pro-rata within the first 14 days of a paid plan; thereafter, fees are non-refundable.
  • We reserve the right to change prices with 30 days’ notice, sent via email to the address on your account.

7. Intellectual Property

  • You retain all rights in the documents and data you upload.
  • Jonga retains all rights in the Service, the API, the dashboard, our brand, and all derivative works.
  • You grant Jonga a limited licence to process your uploads strictly to provide the Service — no training, no retention beyond request fulfillment.

In summary: in-memory processing, no disk persistence of images, no training on your data, and token-level audit logs only.

For POPIA and GDPR purposes, you are the data controller and Jonga is the data processor.

9. Warranty Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, except as required by applicable law.

We do not warrant that OCR extraction will be 100% accurate.

You are responsible for verifying extracted data before relying on it for identity verification, legal, or financial decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Jonga’s aggregate liability for any claim arising from or related to the Service is capped at the greater of (a) R1,000, or (b) the fees you paid Jonga in the 12 months preceding the claim.

We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, revenue, data, or business opportunity.

This clause survives termination of these Terms.

11. Indemnification

You will indemnify and hold Jonga harmless against third-party claims arising from your misuse of the Service or your breach of these Terms.

12. Termination

  • You may terminate your account at any time from the dashboard.
  • We may suspend or terminate your account for breach of these Terms, non-payment, or illegal use.
  • On termination, your API tokens are revoked and your account data is deleted within 30 days, except where retention is required by law.

13. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Republic of South Africa.
  • Any disputes arising from these Terms or the Service will be resolved in the courts of the Western Cape.

14. Changes to These Terms

  • We may update these Terms from time to time.
  • Material changes will be notified at least 30 days in advance via email to the address on your account.
  • Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
